DISPUTE RESOLUTION

Informal Negotiations

To expedite the resolution of any dispute, controversy, or claim related to these Terms of Use (collectively referred to as "Disputes"), both you and BizBox Funnels agree to first attempt to resolve any Dispute informally. Informal negotiations must be initiated by written notice from one Party to the other and shall be pursued for at least thirty (30) days before any arbitration is initiated.

Binding Arbitration

If the Dispute cannot be resolved through informal negotiations, it will be finally resolved through binding arbitration. By agreeing to these Terms of Use, you understand that you waive the right to a jury trial and agree that any Dispute shall be resolved exclusively through arbitration.

Arbitration will be conducted under the Commercial Arbitration Rules of the American Arbitration Association ("AAA"), including the AAA’s Supplementary Procedures for Consumer Related Disputes, if applicable. Your arbitration fees and the share of arbitrator compensation will be governed by the AAA Consumer Rules, and BizBox Funnels will pay for excessive arbitration costs as determined by the arbitrator. The arbitration may take place in person, online, or by phone, and the arbitrator's decision will be final, subject to applicable law.

If any Dispute proceeds in court, it must be filed in the state or federal courts located in Texas. Both Parties agree to submit to the personal jurisdiction of those courts.

Arbitration will only apply to the Dispute between the individual Parties and cannot be joined with other proceedings or arbitrations. There is no right to participate in class actions or representative actions in arbitration.

Exceptions to Arbitration

Certain Disputes are not subject to arbitration, including those seeking to enforce intellectual property rights, allegations of theft or piracy, invasion of privacy, or unauthorized use, and claims for injunctive relief. If a provision of this arbitration agreement is found to be unenforceable, the rest of the provisions will remain in effect.
